Healthcare workers protest short-staffing at John Muir Concord Medical Center

Healthcare workers are gathered at John Muir Health, Concord Medical Center today, Wednesday, March 15, beginning at 11 a.m. until 1 p.m., to protest unsafe staffing levels and their employer’s lack of investment in their workforce. Members of SEIU-United Healthcare Workers West are wearing their uniforms picketing, carrying signs and speaking about what they claim is the hospital’s failure to invest in its patients and caregivers.

According to a press release from the union, “John Muir Health, Concord Medical Center employees say conditions are dangerous for caregivers and patients as management ignores concerns about understaffing and working conditions. Workers are worried about patient and staff safety and say they’ve been pushed to the limit by their employer. They are calling on their employer to listen to and work with healthcare workers to address the staffing crisis through ongoing contract negotiations.”

“We care a lot for our patients, but management isn’t giving us the support we need. Staffing shortages are hitting all departments at our hospital,” said Brian Mynatt, a dietetic technician at John Muir Health, Concord Medical Center. “One of the best ways a patient can recover from an illness is through food and nutrition. But, when we don’t have the staff to get patients the meals they need, it puts their health at risk.”

However, spokesman for the healthcare provider, Ben Drew refutes the claims. In a response statement issued, yesterday he wrote, “The union’s accusations of patients not receiving meals, dangerous working conditions and lack of investment in our employees, are completely false.”

Located at 2540 East Street, John Muir Health, Concord Medical Center’s refusal to invest in its workforce comes in the midst of a healthcare staffing crisis across the state. California faces a massive shortage of allied healthcare workers — job classes that include medical assistants, respiratory therapists, emergency room workers, licensed vocational nurses, lab assistants, housekeepers, and many other frontline staff.

John Muir Health issues statement responding to SEIU-UHW informational picketing at Concord Medical Center

John Muir Health issued the following response to the protest: “SEIU-UHW and John Muir Health just began bargaining for a successor contract for the Concord Medical Center. The current agreement expires in mid-April and we’ve held one bargaining session to date.

The union’s accusations of patients not receiving meals, dangerous working conditions and lack of investment in our employees, are completely false. Notably, not a word was said at yesterday’s bargaining session about patients not receiving meals. At all times, the health and safety of our patients, staff and providers is our top priority.

Like all health systems, JMH has been facing staffing challenges. We have worked hard to address those challenges by hiring 1,125 new employees in 2022, and that hiring process continues.

We have a long history of constructive relationships with the unions that currently represent employees at our Concord Medical Center, including SEIU-UHW. We hope to continue this practice going forward and reach a fair agreement on a new contract. We will continue to bargain in good faith.”

County doctors’, dentists’ union challenges Contra Costa Health Services’ claim severe doctor shortages don’t impact patient care

Last month the Physicians’ and Dentists Organization of Contra Costa (PDOCC) released data showing a high number of doctor vacancies in Contra Costa County Health Services.

According to a Feb. 16, 2023, PDOCC press release, based on county data, there are currently 83 out of 285 employed positions listed as vacant in Contra Costa Health Services, a 29 percent vacancy rate in the system. That includes 27 vacant positions in family medicine and primary care adult medicine, 5 vacant dentist positions and 5 vacant OB/GYN positions. With 19 vacant psychiatrist positions, only 27 percent of employed psychiatry positions are currently filled. 11 vacant employed positions in the emergency department – half of the department’s employed positions – means the county is unable to safely staff the emergency room.

Since November, 5 emergency department doctors have left county employment. The county interviewed and offered positions to 21 new emergency department applicants, but the offer was declined by every applicant.

The problem is expected to get a lot worse in 2024 when Contra Costa County will need an additional 40 primary care providers to care for 30,000 new Medi-Cal patients being added to the county’s health services due to an agreement between the county and California’s Department of Health Services.

The problem continues to worsen. Contra Costa County Health Services added 12,200 patients in the last two months, while only adding 1 new primary care physician. The result is that the average primary care physician employed by the county now has almost 200 more patients on their panel than at the end of 2022. There are no new primary care physicians anticipated to join county employment before July 2023.

On average, the county has only been able to fill three primary care doctor vacancies annually over the last three years.

In response, CCHS Communications Officer Kim McCarl, said doctor shortages are a nationwide challenge, are not compromising care, and confirmed that negotiations between the union and county “are underway”.

She wrote, “We value the medical staff who work across our department.

Health systems across the country are struggling to recruit and retain medical staff at all levels. Contra Costa Health is no different.

It’s important to note that a physician vacancy does not mean that there is a clinical vacancy, nor that care is compromised. We are confident that the right provider is caring for the right patient in the right way at Contra Costa Regional Medical Center and Health Centers every day.

We provide flexibility in work schedule, an emphasis on proactive care, and mission-oriented work that helps us recruit and retain physicians who want to practice in an integrated environment. It’s not uncommon for our physicians to be expert in many areas of clinical medicine which our system values.

We value physicians who embrace our mission and choose to work for Contra Costa Health on a full-time, permanent basis but we also welcome doctors who take a less traditional approach to their careers by working part time or in partnership with other health care entities. These approaches help to alleviate the burnout that has been so costly to hospitals and healthcare systems since the height of the pandemic.

We are proud to be home to one of the most highly rated family medicine training programs in the country. We recruit well-trained physicians who are familiar with our system from each graduating class.

Recruitment and retention of physicians is a top priority at Contra Costa Health. We will continue to explore ways to fill every vacancy across our healthcare system.”

Doctors, Dentists Disagree

That opinion, however, is not shared by the county’s doctors and dentists or by best practice standards for patient care.

The severe shortages most certainly impact patient care, including the time a physician can devote to each patient along with the availability of appointments, according to county doctors.

Contra Costa County’s own policies recommend no more than 1,500 patients to a primary care physician’s panel (the number of patients assigned to a physician). Currently the average panel size for Contra Costa’s employed primary care physicians is 1,879.

“County leaders may be willing to turn a blind eye to severe staffing shortages, but doctors care too much about our patients to let the problem go unaddressed any longer,” said Dr. David MacDonald, PDOCC President. “We hear from patients all the time about how difficult it is for them to schedule appointments in our system. When they finally get an appointment, it is rarely for the amount of time they need because doctors are overstretched and taking on more patients because of all the vacancies. The patients who rely on Contra Costa County Health Services for care should not have to settle for less time and attention than patients in other systems or ones with private healthcare.”

In addition to the primary care vacancies, there are 5 vacant dentist positions and 5 vacant OB/GYN positions. With 19 vacant psychiatrist positions, only 27 percent of employed psychiatry positions are currently filled. 11 vacant employed positions in the emergency department – half of the department’s employed positions – means the county is unable to safely staff the emergency room.

The problem is expected to get exponentially worse in 2024 when Contra Costa County will need an additional 40 primary care providers to care for 30,000 new Medi-Cal patients being added to the county’s health services due to an agreement between the county and California’s Department of Health Services.

PDOCC is calling on county leaders to be proactive by filling the position vacancies which will improve patient care and support county revenues. “It’s hard to believe that Contra Costa County is not working more closely with our union to help it become more attractive and competitive in retaining and recruiting medical and dental talent. I believe the county is moving in the wrong direction and I’m concerned that patients are being put at risk,” MacDonald said.

PDOCC members are currently in negotiations with county management towards a new contract. Issues raised in negotiations by PDOCC members include high patient caseloads, insufficient time for administrative tasks, long waits for primary care appointments and specialty referrals, chronic short staffing and high turnover – all of which combine to negatively impact patient care and health impacts. PDOCC members also state that burnout is at an all-time high.

County Health, PDOCC Respond to Questions

Questions were sent to both McCarl and the union’s spokesman asking if the PDOCC is in the midst of contract negotiations with the county and if so, is this an effort to obtain an increase in compensation for its members.

While McCarl responded, “Yes, negotiations are underway” she did not respond to the additional question about their criticism.

The questions were also sent Tuesday afternoon to Dr. David MacDonald with the PDOCC.

He responded, “PDOCC is engaged with Contra Costa County in negotiations at the level of state mediation. We have one more session to go.

We are focused on improving patient care and making the workplace in Contra Costa Health Services (CCHS) more sustainable.

We have to be able to hire new medical and dental talent, so compensation has to be more market competitive. This would also help with retention. A bigger medical and dental staff would help alleviate some of the load that our current employed members are carrying. The situation at this time is untenable. And, per an agreement between CCHS and the state’s Department of Health Services, CCHS will become the single system to provide care for MediCal patients in the county (aside from small fraction of MediCal patients covered by Kaiser). This will mean for an additional 30,000 new patients into our system as of January 1, 2024. We’re not ready for that. We will need an additional 40 new primary care providers to handle the influx of new patients. The County is nowhere close to hiring that many (I believe the County has 3 new providers scheduled to start after July of this year).

In addition, half of our emergency department employed positions are vacant. This means that the County partially fills the gap with very expensive temp doctors. We think it would be smarter for the County to take the funds doled out to temps and invest that money in committed, dedicated and County career minded docs who will be here for the long term.

Another issue is that our primary care providers need more protected time to manage their patient panels. The in-basket work – lab follow up, med refills, answering patient calls & emails, etc., has been escalating. Our physicians take this work home with them and it takes away time from their families and individual restorative activities.

All of this after the three-year pandemic onslaught has left our physicians and dentists suffering more from burnout than ever before. The County must step up, be proactive, and work with our union on how to achieve meaningful improvements that will enhance patient care and move our system in the right direction.”

Profile in Courage: Brentwood middle-schooler braves battle with childhood kidney cancer

Maria Muñoz vividly remembers the day last September when her 11-year-old son Cristian was injured playing football with his friends.

He jumped up to catch a ball, but accidentally fell. Cristian felt intense stomach pain; something didn’t feel right. He called his mom and she raced to school to pick him up. Later that evening, Cristian ended up in the Kaiser Permanente Antioch Medical Center emergency room.

“Every minute, his pain was increasing,” said Munoz, an instructional aide at Pioneer Elementary School. “It was awful. They told us that Cristian had internal bleeding and a possible mass.”

It was soon determined that the energetic boy had a common form of childhood kidney cancer known as Wilms’ tumor. The impact of the football injury ripped the tumor and caused Cristian’s excruciating pain. Cristian was sent to Kaiser Permanente Oakland Medical Center for surgery where he was cared for by a team of physicians and nurses, including Surgeon Sani Yamout, MD, and Pediatric Oncologist Caroline Yingwen Hu, MD.

“Wilms’ tumor is the most common childhood kidney cancer,” Hu noted. “We see several cases each year. Symptoms can include belly pain, belly swelling, blood in the urine, nausea and vomiting.”

However, Cristian didn’t have these symptoms because his cancer presented suddenly, Hu said. Because of that, doctors had to quickly determine a treatment plan that included surgery, chemotherapy and radiation.

Munoz said Cristian’s Kaiser Permanente doctors and nurses have been “one hundred percent amazing.”

“I’ll never forget the nurse who held my hand before Cristian’s biopsy,” she added. “He said, ‘Your son is going to be just fine.’ That made me feel safe. Another nurse was wonderful to Cristian. She wrote him notes, sent him inspirational quotes and told him to stay strong.”

Muñoz shared that some days more difficult than others.

“There are days when I go into my closet and cry,” she said. “That releases my stress, and it helps. However, our support network has been incredible. So many of our friends and family members have brought us meals and have visited Cristian to cheer him up—he loves that. The community of Brentwood has supported our family tremendously. We are so grateful.”

Community Spirit

Cristian, a Bristow Middle School student, said his courageous battle has taught him many life lessons, especially the importance of community.

Cristian has been surrounded by the love and support of his family and friends. His parents, Maria and Joel, and his siblings—Anthony, Jonathan and Liliana—have lifted his spirits and have encouraged him to stay positive and strong. Cristian’s friend, Liam Freitas, sold “Team Cristian” bracelets to the local community.

“Cristian is so brave and gregarious,” Hu said. “He has tons of friends and a very close-knit family.”

In December, Cristian was honored at Brentwood’s community-building event, Tunnels of Joy. Since 2016, Brentwood residents have walked through glorious lights to honor cancer patients. The popular fundraiser was named after Joy Bursch, who passed away in 2009. The colorful lights on La Costa Street illuminate the neighborhood and create an inclusive ambiance of unity, holiday spirit and joy.

“The highlight of Tunnels of Joy was all the attention I received,” Cristian said. “I felt famous. I loved being able to see my friends, all the lights and the hot chocolate.”

Cristian, like many other middle-school students, enjoys listening to music and playing video games on his Xbox. He hopes to inspire other young cancer patients on his journey.

“I would advise other children battling an illness to stay strong and find a hobby that will distract your mind,” Cristian said. “If you don’t like your medication, just plug your nose and take it. My goals for the future are to be healthy and strong, and to continue to play sports. My illness has taught me how much my family and friends love and care for me.”

Contra Costa seeks volunteers for oversight of Martinez refinery release investigation

Contra Costa County seeks community volunteers for a committee to oversee an independent investigation and risk assessment of the Nov. 24-25 release of heavy metals into the surrounding community by Martinez Refining Company (MRC). (See related article)

The oversight committee will advise the Contra Costa Board of Supervisors and Contra Costa Health’s (CCH) Hazardous Materials Program on the hiring of contractors to probe the cause of the release, and separately the impact that it had on community health and the environment. The committee will review and direct the work as it proceeds and is ultimately reported to the Board and the public.

The Ad Hoc Committee for the Industrial Safety Ordinance and Community Warning System, a subcommittee of the Board of Supervisors, directed CCH at its Jan. 12 meeting to lead the community-involved investigation and risk assessment, parallel to the investigation MRC is legally required to conduct.

The nine-member oversight committee will be chaired by a Hazardous Materials Program staff member and include representatives from the City of Martinez, MRC, the labor organizations representing MRC workers, and five at-large members from Martinez, Pacheco, or other communities near the refinery.

From about 9:30 p.m. Nov. 24, 2022, to the early hours of Nov. 25, MRC inadvertently showered surrounding neighborhoods with more than 20 tons of spent catalyst, a dust-like substance that CCH later determined to contain elevated levels of aluminum, barium, chromium, nickel, vanadium and zinc.

MRC did not report the release via the county Community Warning System or directly to CCH as required by the county’s notification policy, preventing an immediate regulatory response or prompt safety messaging to affected neighbors. CCH has referred that matter to the Contra Costa District Attorney’s Office for consideration of legal action.

In midst of “Tridemic” county Health Services, Kaiser partner to help Contra Costans make best health decisions

New webpage offers tips, insights to help people understand when to reach out to doctors, hospitals

Battling the triple threat of COVID-19, influenza and respiratory syncytial virus (RSV) people of all ages are finding themselves sick as this “Tridemic” rages on. With emergency rooms and hospital beds filling up, Contra Costa Health and Kaiser Permanente have partnered to launch a public health education campaign to inform the community about simple self-care recovery tips and virtual treatment options for common illnesses.

“By partnering with Contra Costa Health, we bolster our efforts to disseminate critical health tips to our members and many others throughout the community,” said Dr. Sharon Mowat, pediatrician and physician-in-chief for the Kaiser Permanente Diablo Service Area. “If we can help people safely recover from the comfort of their homes, we can also lessen the extremely long wait times that people are seeing in the overcrowded doctors’ offices and emergency rooms throughout our community.”

The two organizations created a webpage in English (www.coronavirus.cchealth.org/get-care) and Spanish (www.coronavirus.cchealth.org/get-care-es), with information and resources about how people can recover from illnesses and access care from the comfort of their homes. If people have urgent or immediate concerns, they are encouraged to call an advice nurse or doctor’s office for guidance and virtual appointments by phone or video. Contra Costa Health Plan members and people who don’t have health coverage can call the advice nurse at (877) 661-6230. Kaiser Permanente members can call the advice nurse at (866) 454-8855.

Hospitals and ambulances are especially impacted during the winter virus season, so Contra Costa Health and Kaiser Permanente caution people to only call 911 or go to the hospital if their need for care is truly an emergency.

“The good news is most people who get sick can safely recover from home,” said Dr. Sofe’ Mekuria, deputy health officer for Contra Costa Health. “We want people to know the home care options available to them and know how to prepare themselves so they can recover quickly and safely if they get sick.”

Health recommendations include staying home when sick, getting lots of rest, drinking plenty of fluids and separating from others to avoid spreading illnesses. For peace of mind, people are encouraged to stock their medicine cabinets with items including over-the-counter cold/flu medicines to reduce fever and pain, saline spray or drops, cough syrups and lozenges, and COVID-19 home tests.

In addition to the webpage, a communications toolkit with digital graphics and handouts is also available for local schools, businesses and community organizations to share with their members.

Fresh Approach mobile farmers’ market brings healthy fruits and veggies to West Contra Costa residents

Richmond resident Marsha Quick has more energy and has reached a healthy weight since she started visiting the Fresh Approach mobile farmers’ market at the Richmond Public Library on Wednesday mornings. She credits the truck for giving her a new appreciation for healthy foods.

“It has changed how I eat,” she said. “I used to hate broccoli, but now I have it four times a week because it’s so fresh. I’ve also learned how to make sweet potato tacos with ground turkey and spices. Most of all, I enjoy meeting other Richmond residents in line – I’ve made a lot of friends out here.”

Fresh Approach is a Bay Area nonprofit dedicated to connecting residents to healthy food from California farmers and to expanding knowledge in the community about food and nutrition. Its mobile farmers’ market truck, stocked with fresh fruits and vegetables, serves six cities in three Bay Area counties.

“The COVID-19 pandemic and recent inflation concerns have increased the number of Bay Area residents who face food insecurity,” said Fresh Approach Food Access Program Manager Ellen Olack. “We’ve seen lots of changes pre- and post- pandemic. More folks are coming out each week.”

The Fresh Approach truck stops at three locations on Wednesdays – the Richmond Public Library, the San Pablo Senior Center and the Richmond Parkway YMCA. The Richmond route and a similar route in Antioch are funded in part by Kaiser Permanente.

Yvette Radford, Kaiser Permanente’s Northern California vice president of External and Community Affairs, noted that having access to affordable, nutritious food is critical for good health.

“That’s why we have partnered with Fresh Approach to provide fresh produce every week to West County residents who are struggling to make ends meet during these challenging economic times,” she said. “This partnership reflects our deep commitment to improve health in the communities we serve and help people live longer, healthier lives.”

Fresh Approach offers a 50 percent discount to customers who participate in income-based benefit programs, including CalFresh (SNAP), WIC, SSI/SSDI, Medi-Cal and unemployment.

For Sharolyn Reed, the mother of three young children, the food truck has been life changing. It has enabled her to plan nutritious meals for her family every day and be more conscientious about healthy snacks.

“My kids look forward to eating apples and fresh vegetables every day,” she said. “I always have them on hand now.”

Fresh Approach Community Ambassador Towanna Turner said her primary goal is to help Richmond residents prevent various diseases by providing easy access to nutrient-rich food.

“I’ve seen people with tears in their eyes because they’re so grateful for healthy food,” she added. “I love being an ambassador because I’m able to help people live better lives.”

Every Wednesday, the Fresh Approach Mobile Farmers’ Market truck stops at the Richmond Public Library from 10 a.m. to 11 a.m. It moves to the San Pablo Senior Center at 1943 Church Lane  from 11:45 a.m. to 12:45 p.m. The last stop of the day is the Richmond Parkway YMCA at 4300 Lakeside Drive from 1:45 to 2:45 p.m.

Contra Costa residents urged to use 911 only for emergencies

Especially during flu season; ConFire says respiratory virus calls are straining CCC EMS resources

To ensure continued timely response to true medical emergencies, Contra Costa Health (CCH) encourages residents to call 911 only if the need for care is truly an emergency.

Contra Costa County’s emergency medical system traditionally serves higher-than-usual numbers of patients this time of year, and this month healthcare providers and the agencies providing emergency ambulance service are especially impacted because of COVID, flu and other respiratory viruses.

According to Con Fire, “Respiratory virus calls are straining CCC EMS resources.”

Several hospitals in the community are reporting critically high level of patients occupying beds, with more than 1,200 inpatients reported throughout the county as of Friday. Hospital emergency departments are similarly impacted.

Calling 911 for your health emergency is recommended if it involves:

  • Chest pain, difficulty breathing or a fast (120+ beats per minute) resting heartbeat
  • Numbness or weakness in any part of the body, seizures, or difficulty speaking
  • Fainting, unconsciousness, dizziness, sudden severe pain or headache, or confusion
  • Sudden blindness or vision changes
  • Heavy bleeding that will not stop with pressure, or broken bones
  • Choking, drowning or near drowning
  • Severe burns
  • Poisoning or drug overdose
  • Allergic reactions, especially if there is difficulty breathing
  • Someone making a credible threat to harm themselves or someone else

There are other good reasons to call 911 as well. But to reduce strain on the county’s healthcare system, CCH asks anyone considering whether to seek emergency care if a 911 call is the best way to get the services they need, or if contacting an advice nurse or urgent care might be more appropriate.

When many people seek care through 911 at the same time, it reduces the number of emergency ambulances in circulation, ready to respond when someone in the county needs lifesaving care.

Based on a paramedic’s assessment of a patient’s condition and if the number of available emergency ambulances is very low, the paramedic may suggest a patient visit an urgent care on their own or call an advice nurse.

During the winter virus season, patients visiting emergency departments at hospitals in the county may also need to wait longer depending on circumstances at the time they arrive and the severity of their illness or injury.

Hazardous materials release at Martinez oil refinery contained heavy metals

A powdery substance released into the community by Martinez Refining Company (MRC) last week contained higher-than-normal amounts of heavy metals, tests of samples collected by Contra Costa Health (CCH) show.

CCH does not believe there is an immediate health risk to the community. The most significant health risks were short-term respiratory impacts from breathing in the metals in the hours after the release. Exposure to high concentrations of these metals over a long period of time could cause more serious health problems.

The accidental release of “spent catalyst” from the refinery began about 9:30 p.m. on Thanksgiving and into the early morning hours of Friday, Nov. 25. CCH’s testing of samples taken near the refinery showed levels of aluminum, barium, chromium, nickel, vanadium, and zinc higher than normal background levels for those metals.

CCH and the County’s Community Warning System were not notified of the release as required by law. CCH’s HazMat team learned about the release on Saturday morning after seeing community complaints about white dust on surfaces near the refinery. In its amended 72-hour report regarding the incident submitted to the health department, MRC says it is investigating why those notifications were not made.

“Martinez residents need an immediate response when there is a release at the refinery,” said Deputy Health Director Matt Kaufmann. “MRC’s failure to follow notification procedure cost us critical time we could have used to warn the public and reduce health risks in the community. It’s unacceptable.”

Anyone exposed to the material released from the Martinez refinery who is experiencing respiratory symptoms such as coughing, sore throat or difficulty breathing should contact their healthcare provider. People should avoid handling or breathing any remaining dust that has settled on the ground or other surfaces.

“We are concerned for people’s health anytime they are exposed to toxic metals,” said Dr. Ori Tzvieli, health officer for Contra Costa County. “Our goal going forward is to make sure something like this doesn’t happen again.”

MRC, owned by PBF Energy, had initially told the community that its own testing of samples collected from the release suggested it was a non-toxic mixture of materials. The company also offered free carwash vouchers to Martinez residents.

Industrial facilities such as MRC are required by state law and county policy to immediately report the release or suspected release of hazardous materials to emergency response authorities, including the county’s Community Warning System, which sends text and telephone messages with emergency instructions to affected parts of the county.

CCH is continuing to investigate the incident and will hold MRC to its legal responsibilities to cooperate with its review of this release. More information will be posted at cchealth.org as it becomes available. – Safety Data Sheet (SDS) – Catalyst

California receives $1.2 million of settlement with Concord nursing home for poor care

California Attorney General Rob Bonta on Tuesday secured a settlement against a Contra Costa County skilled nursing facility resolving allegations of understaffing and patient abuse and neglect. The settlement resolves claims that for five years, San Miguel Villa subjected its patients to poor care due to understaffing and effectively rendered a number of its services useless. The settlement amounts to a total of $2.3 million, with California receiving $1.2 million. (See related article)

“Corporate profits should never be placed above patient needs and care,” said Attorney General Rob Bonta. “Every patient is entitled to humane care, and skilled nursing facilities should always have the appropriate level of staffing to ensure this standard of dignity is met. I want to thank the U.S. Attorney’s Office for their critical help during the course of this investigation. With the help of our federal partners, my office will continue to protect the well-being of all Medi-Cal beneficiaries.”

In June 2017, the California Department of Justice’s Division of Medi-Cal Fraud and Elder Abuse (DMFEA) responded to a report from the U.S. Attorney’s Office for the Northern District of California (USAO) involving allegations of overmedication of residents at San Miguel Villa. The USAO requested DMFEA’s assistance in the investigation. Conducted by DMFEA and the USAO, the investigation analyzed residents’ medical charts, surveys from the California Department of Public Health, prescription records, and publicly available staffing information from 2012-2017 – the time frame when the alleged mistreatment occurred. The investigation uncovered evidence of understaffing at the facility resulting in harm to residents, such as increased falls, patient-on-patient violence, weight loss, and overmedication to render patients more manageable. Tuesday’s settlement amounts to a total of $2.3 million, with California receiving $1.2 million.

The California Department of Justice’s DMFEA protects Californians by investigating and prosecuting those who defraud the Medi-Cal program as well as those who commit elder abuse. These settlements are made possible only through the coordination and collaboration of governmental agencies, as well as the critical help from whistleblowers who report incidences of abuse or Medi-Cal fraud at oag.ca.gov/dmfea/reporting.

DMFEA receives 75% of its funding from HHS under a grant award totaling $53,792,132 for federal fiscal year 2022-2023 The remaining 25% is funded by the State of California. The federal fiscal year is defined as October 1, 2022, through September 30, 2023.
