Byron-based Patriots Jet Team planes and pilots help make Top Gun: Maverick movie magic

Planes, aerobatic pilots, crew chiefs and other members of the Patriots Jet Team based at the Byron Airport in Contra Costa County helped make the new movie Top Gun: Maverick, starring Tom Cruise, now in theaters. As in the original Top Gun film, the sequel features a variety of jet training and combat scenes in which the team provided their L-39 CineJet™ to film the high-speed, in-air shots.

According to their website, the Patriots Jet Team is the largest civilian-owned aerobatic jet team in the western hemisphere. The team was started in 2002 by founder and owner Randy “Howler” Howell, a Discovery Bay resident, who also helps pilot the special jet. Howell has more than 26,000 hours of flight time and over 30 years of flying experience with United Airlines. He has been an advanced instructor in aerobatics, formation, UPRT (upset prevention and recovery training) as well as a Check Airman and Simulator Instructor in a multitude of aircraft.

The CineJet™ high-speed, cinematography platform was launched in 2017 when the Patriots Jet Team partnered with Helinet.

In a March 2 post on the team’s Facebook page it shows a brief video during filming of the movie from the CineJet™ Facebook page asking, “Recognize the jet?”

In another Facebook post on April 1 it reads, “The Patriots are so excited to finally see Top Gun Maverick come out. The #cinejet was key to many of the aerial scenes, can’t wait to see them on the big screen.”

Then on April 18 the team posted, “Lots of Patriots L-39’s in the latest #topgunmaverick Trailer. https://twitter.com/tomcruise/status/1516039183332216838…”

A June 6 post on their Facebook post reads, “If you haven’t already seen Top Gun: Maverick, you won’t want to miss our Helinet CineJet aerials on the big screen! #TopGun #TopGunMaverick #TGM #CineJet #PatriotsJetTeam” and includes a brief trailer from the movie.

At the Top Gun-themed, Patriots Jet Team Foundation annual fundraiser last September, the Guest of Honor and speaker was American actor, writer and producer Glen Powell, who is co-starring in Top Gun: Maverick. He plays the part of pilot, Lt. Jake ‘Hangman’ Seresin. The evening’s program also included a special behind the scenes look at the involvement the Patriots Jet Team pilots had in the aerial shooting of the new movie.

Howell Provides Details of His Team, CineJet, Filming and Training Cruise and the Other Actors

According to Howell quite a few members from the team participated in the making of the film, which includes two pilots, Howell and Scott “Intake” Kartvedt, and five crew chiefs to mention a few.

He provided more details about his organization and the filming of the movie.

The team provides three services, “one is flying a six-ship airshow similar to the Blue Angels or the Thunderbirds,” he shared. “We also provide upset training, teaching corporate and airline pilots how to recover from an unusual attitude or an upset due to wake turbulence, weather, or mechanical failures, flight controls.”

The third piece of the puzzle, is “the CineJet operation for filming,” he stated. “We partnered up with Helinet, a company in Southern California. They own the Shotover F1 which is a large, gyro-stabilized platform which can hold many different types of cameras for filming.”

“We designed, engineered and mounted it to the front of a highly modified L-39 Albatross jet.”

“This all started when my good friend, Kevin LaRosa, Jr., who I have shot commercials and movies with, in the past, came to me and said, ‘hey, would you be interested in partnering up on putting a big, Shotover F1 system on the front of an L-39?’” Howell explained. “My first question was that’s usually used on helicopters with a maximum speed of 150 knots. We need to go a lot faster if we’re going to start doing aerial filming of Top Gun and the likes.”

LaRosa has worked in the film industry for over 16 years as a stunt pilot and aerial coordinator. He and Howell are the pilots for the CineJet.

“So, we worked with the company Shotover based in New Zealand and they then started doing modifications to the six-axis, gyro-stabilized system that can be controlled, to look straight up, straight down, behind you, right and left,” Howell stated. “We needed to do 350 knots and sustain three G’s for maneuvering with the Super Hornets in the movie. So, they modified the arms, gears, motors and other items within the unit. They would then send it to us, and we’d test it up to the next speed, and the next until we reached 350 knots and 3.5 G’s. They did a lot of studies in the wind tunnel and a lot of engineering prior to this.”

“Once it was ready to go, we started launching every jet that every friend had, corporate jets.  I flew the Mig-17, the Saberliners, as well as multiple L39’s intermixed with the Mig-17 and we created an exciting, one-minute sizzle reel,” Howell continued. “We sent that to Paramount, and they contacted us and said, ‘we like it. We want to talk.’ So, that’s how it all started.”

Work on Top Gun: Maverick

“We were then contracted to work on three different areas for the movie over about a year-and-a-half period,” he shared. “First was filming the Super Hornets in flight and the majority of the tactics that you see in the movie. The second was training all of the actors and actress, Monica (Barbaro) is the only actress who portrayed a pilot in the movie. We flew with every single one of the actors including Tom. He then wanted to get checked out in the airplane because he loved the L-39 so much. I flew with Tom many times getting him up to speed in the airplane.”

“The purpose for training all the actors and Tom was the Super Hornet was going to be pulling up to seven-and-a-half G’s,” Howell explained. “So, we went up in the L-39 which is stressed to eight G’s and we flew over, and over and over again at eight G’s. We flew up to 18,000 feet, we’d get a lot of energy up and we would put it into a spiral and sit at eight G’s for long periods of time. That was to get all of them into a mindset that they could act, which is a lot of energy. Acting, you can’t be putting energy into getting sick and nauseas, throwing up and all of that, and acting. So, we flew a lot with all of them.”

“Then Tom loved the airplane so much, and Tom is an awesome pilot, a really, really good pilot, and a really good formation pilot, as well, which is a whole different skill set from normal aviating” Howell shared. “I trained him, and he took a check ride with the FAA. Now, he’s qualified to fly by himself in the L-39 or with other people.”

He then mentioned a video of Cruise in which he flew TV talk show host James Corden in the L-39.

“The other piece of the puzzle was to paint two of our L-39’s in movie grey, sort of a flat, grey color and then put targets on both sides of the tail, both sides of the nose, top and bottom of each wing,” Howell explained. “Production was not able to get a flying F-14 because they don’t fly anymore, they’re all retired and they couldn’t get a Russian Sukhoi 57, either. We did the flying for that.”

“So, it’s real flying,” he added.

“They blocked off 40 miles of the Feather River for us up near Chico,” Howell said. “Then one of our pilots, Scott ‘Intake’ Kartvedt, a former Hornet and Blue Angel pilot in the Navy, and I flew all the two-ship stuff with the two Su-57’s and the F-14 through the Feather River. When we did that, it was about a six-week project, and we flew two to three times every day. We also flew off the coast of Point Mugu for the over water, ocean scenes with the two airplanes along with the CineJet filming us.”

“The first time we flew, we scouted the river in a helicopter,” he explained. “There’s a lot of hairpin turns, reversals, with granite walls, a thousand, two thousand feet high on both sides of you. So, as you come up on these switchbacks, come back the other way, you need to know you’re going to be able to come around there and some of them you can’t, they’re too tight. So, now you’ve got to come up over top of the mountain, roll inverted, pull down the other side of the mountain and roll out. All while being filmed by a helicopter or the CineJet with Shotover systems on them.”

“After we flew the first one in the L-39’s and spending several days scouting the area, taking notes, memorizing exactly which turns you were going to make all the way around, which turns you had to come over the top in,” Howell shared. “And we were down in the dirt, we were down 10 feet off the trees through a lot of that and the first time we landed the two of us were visibly, our hands were shaking. We walked toward each other and hugged, ‘Intake’ backed up and said, ‘I have 153 combat missions under my belt. I’ve never been under such high stress flying, before.’”

“So, it was definitely high-risk, but very calculated in the way we executed with all the scouting ahead of time,” he continued. “We started flying up higher, first. Then we came down as we got more comfortable and then we started filming once we got really comfortable down low.”

Asked how many times they flew the canyon route Howell responded, “many, many, many times.”

“You know to get one second of film, you’re gonna film an hour,” he said with a chuckle.

“Every last, little detail in the Super Hornets, everything, everything is the real deal,” Howell stated. “All the internal cameras they would mount inside one of our L-39’s for proof of concept to show what it would look like to the producers, to the director, and what angles they wanted. Then they could go the Navy and say, ‘we’ve already tested all these cameras in the airplane now, we need to mount them inside your airplane’.”

“That’s the whole story of Top Gun. A year-and-a-half involvement, but we were not filming for a year-and-a-half,” Howell shared. “We might film for six weeks, then have a month or two off. Then we’d go back and film for a month or two months, and then we’d have time off. So, it was just over a period of a year-and-a-half.”

They started filming in 2018 and finished up in 2019.

Filmed Another Movie Set During Korean War

Howell then shared about another movie they filmed, “which is going to be spectacular. It’s based on a true story, during the Korean War era where there’s an African American and a white pilot in flight school. The African American was a sharecropper’s son. He was homeschooled. He only wore shoes on Sunday. The white pilot’s dad was a prominent attorney, he belonged to the country club. The two of them became best friends in flight training.”

“They finished flight training and started flying in combat. They were assigned to F-4U Corsairs, the gullwing Corsair, and they went into battle,” he continued.

“I won’t ruin the rest of the story for you,” Howell stated. “There’s a book out called ‘Devotion’ by Adam Makos. You can order it on Amazon. It’s a really, really good story and it’s a true story. I love true stories. It’s going to be a great movie.”

The aerial scenes were filmed in 2021, January to March in Wenachee and Pasco, Washington and then Savannah, Georgia.

The name of the movie is the same as the book, “Devotion” and will be in theaters Thanksgiving weekend beginning Wednesday, Nov. 23.

“Our good friend, Glen Powell, who starred in Top Gun and others, and who was our speaker at our fundraiser is one of the two stars, he plays the pilot/character ‘Tom Hudner’,” Howell shared.

He also played John Glenn in the movie Hidden Figures, “and he’s starred in other movies, as well,” Howell added.

Q&A

Asked how many members from the team participated in the filming of Top Gun: Maverick he said, “There was probably seven of us at different times. We took different crew chiefs who would maintain the airplanes. We have a big hauler, an 18-wheeler and it carries spare everything for the L-39’s. Then we took Jet 7 and Jet 8 which are both set up with the Shotover wiring. There’s a lot of mods to the airplane before mounting the camera. So, we had both airplanes at every event. We had other airplanes there too for doing other training, as well.”

Asked how many pilots the team has Howell said, “we have six airshow pilots.”

According to the Patriots Jet Team website, “they have logged over 105,000 hours of flight time and performed in more than 1500 air shows.” Most recently, they performed over Venice and Mandeville Islands in the Delta prior to the fireworks show on Sunday evening, July 3.

Lastly, the accomplishment that Randy is most proud of is the Patriots Jet Team Foundation, a separate non-profit 501 (c) (3) corporation which he founded in 2011.

“The Foundation educates and mentors youth in America in aviation/aerospace and STEM career paths. The Foundation has partnered with other STEM based Foundations, as well as public, private, charter and University school programs.” Howell shared. “We cater to nearly 10,000 kids a year with rocket launch competitions, high-altitude balloons, introduction to aviation classes, aerodynamic classes and many more that we do, right here, at our facility as well as in the public schools system.”

According to their website, the Richmond Promise works to increase the number of students, particularly low-income students and students who are the first in their family to go to college who:

  1. Are exposed to college resources, role models and experiences throughout K-16
  2. Successfully transition to an accredited university/college directly from high school
  3. Successfully transfer from community college to 4-year university
  4. Complete an Associate Degree, Bachelor’s Degree, or career + technical education

The non-profit organization believes “all students deserve access to higher education and the tools to achieve their dreams.”

The Richmond Promise Scholarship is a $1,500 college scholarship, renewable for up to 4 years. Students may attend a 2-year or 4-year college, and/or pursue a Career Technical Education Certificate at any not-for-profit institution in the United States.

Kaiser Permanente behavioral health professionals mentor students at Antioch’s Dozier-Libbey Medical High School

To inspire, educate and impart life skills to future mental health professionals

Like many high schoolers, students at Dozier-Libbey Medical High School in Antioch, California, are unsure about their career moves post-graduation. With the help of a mentorship program led by Kaiser Permanente Northern California’s Mental Health Training Program, these students are getting a window into the behavioral health medical profession.

“Everyone has a different path in life, and my mentor allowed me to see the huge variety of pathways available to me,” said 18-year-old Syncere Jordan. “She told me what it took to get where she is today and what the day-to-day responsibilities of a health care worker are.”

Kaiser Permanente Northern California partnered with the 800-student high school last year to create a mentorship program in which 12 students meet virtually every week for 30 minutes with a mental health provider to talk about career pathways, resumes, college, and the realities of working as a mental health professional.

“I really appreciate the diversity the program allows,” said 16-year-old Emma Mauri. “My mentor and I have talked about everything from life skills, to education, to just telling stories. She’s inspired me to stop being so nervous about the decisions I’m facing about the future of my career.”

Giving back to student and mentor

Reflecting Kaiser Permanente’s core commitment to support mental health and wellness in the communities it serves, every mental health trainee of the Mental Health Training Program is required to complete over 30 hours of community outreach. The outreach focuses on improving the mental health of the local community in some important respect, beyond treating Kaiser Permanente members.

The mentors said educating young people on the importance of mental health and helping guide their future has been very fulfilling.

“As a first-generation Mexican American and first in my family to graduate college, I’m incredibly passionate about supporting these young people and creating awareness around the complex experiences of being a first-generation student,” said Irais Castro, PhD, a psychology postdoctoral resident at Kaiser Permanente Antioch.

“It’s important to foster these student’s interest in mental health or whichever field they are interested in,” said Nicole Wilberding, PhD, a psychology postdoctoral resident at Kaiser Permanente Walnut Creek. “We encourage them to talk about their concerns and fears so they don’t feel overwhelmed about their future.”

Increasing awareness of mental health care

A goal of the 8-week mentorship program is to increase awareness about the field of clinical psychology and mental health among diverse youth populations. Kaiser Permanente shares in the U.S. challenge to meet the demand for mental health care that has been greatly exacerbated by the national shortage of trained mental health professionals.

Although many of the students involved in the mentorship program had not considered a career in mental health, some of them said they are now interested in learning more about the profession as a possible career choice.

Kathryn Wetzler, PsyD, regional director of Mental Health Training Programs, said, “It’s really valuable to identify the young people who are interested in mental health as a career and provide them with the understanding of what being a mental health professional is all about.”

Castro explained that it’s a vital time to educate people about the importance of mental health as a profession.

“We need more clinicians of color and diverse populations in the field, so I am grateful to have the opportunity to create awareness of the need.”

For Jordan, who is 3 months away from graduating high school, her relationship with her mentor is a “bond I will never forget and hope to continue after I graduate.”

Gov. Newsom lifts mask mandate for unvaccinated indoors March 1, schools March 12

Joined by governors of Oregon, Washington to offer more updated health guidance for the three western states

SACRAMENTO – With declining case rates and hospitalizations across the West, California, Oregon and Washington are moving together to update their masking guidance. After 11:59 p.m. on March 11, California, Oregon and Washington will adopt new indoor mask policies and move from mask requirements to mask recommendations in schools.

State policies do not change federal requirements, which still include masks on public transit.

Statement from California Governor Gavin Newsom: “California continues to adjust our policies based on the latest data and science, applying what we’ve learned over the past two years to guide our response to the pandemic. Masks are an effective tool to minimize spread of the virus and future variants, especially when transmission rates are high. We cannot predict the future of the virus, but we are better prepared for it and will continue to take measures rooted in science to keep California moving forward.”

In California, starting March 1, masks will no longer be required for unvaccinated individuals, but will be strongly recommended for all individuals in most indoor settings. After March 11, in schools and childcare facilities, masks will not be required but will be strongly recommended. Masks will still be required for everyone in high transmission settings like public transit, emergency shelters, health care settings, correctional facilities, homeless shelters and long-term care facilities. As always, local jurisdictions may have additional requirements beyond the state guidance.

Newsom also presented his COVID SMARTER Plan introduced on Feb. 17, which stands for Shots, Masks, Awareness, Readiness, Testing, Education and Rx.

Statement from Oregon Governor Kate Brown: “Two years ago today, we identified Oregon’s first case of COVID-19. As has been made clear time and again over the last two years, COVID-19 does not stop at state borders or county lines. On the West Coast, our communities and economies are linked. Together, as we continue to recover from the Omicron surge, we will build resiliency and prepare for the next variant and the next pandemic. As we learn to live with this virus, we must remain vigilant to protect each other and prevent disruption to our schools, businesses, and communities––with a focus on protecting our most vulnerable and the people and communities that have been disproportionately impacted by COVID-19.”

In Oregon, the Oregon Health Authority rules requiring masks in indoor public places and schools will be lifted after 11:59 p.m. on March 11. Other state and federal requirements, such as those for health care settings, public transit, and other specialized settings, will remain in place for a period of time.

Statement from Washington Governor Jay Inslee: “We’ve continued to monitor data from our state Department of Health, and have determined we are able to adjust the timing of our statewide mask requirement. While this represents another step forward for Washingtonians, we must still be mindful that many within our communities remain vulnerable. Many businesses and families will continue choosing to wear masks, because we’ve learned how effective they are at keeping one another safe. As we transition to this next phase, we will continue to move forward together carefully and cautiously.”

In Washington, indoor mask requirements will be lifted as of 11:59 p.m. on March 11. This new date does not change any other aspect of the updated mask requirements Inslee announced last week. Masks will still be required in certain settings including health care, corrections facilities and long-term care facilities. The Washington State Department of Health will be issuing new guidance for K-12 schools next week so schools can prepare to implement updated safety protocols.

Embattled chancellor of Contra Costa Community College District resigns

At their February 16, 2022, meeting, the Governing Board (Board) of the Contra Costa Community College District accepted the resignation of Dr. Bryan Reece, effective February 11, 2022. He began working for the District as the ninth permanent chancellor on November 1, 2020.

Reece was placed on paid administrative leave by a unanimous vote of the board during a closed session meeting earlier this month. It was the second time the board had done so, the first time occurring in September on a split vote of 3-0-1 with Area 5 Trustee Fernando Sandoval voting to abstain as he was attending the meeting via Zoom. In an email to faculty and staff, Jeffrey Michels, president of the United Faculty, wrote about the board’s decision to place Reece on paid leave for a second time.

“In the words of the Yankees’ Yogi Berra, ‘it’s like déjà vu all over again.’ Last week, with no public explanation besides citing ‘personnel matters,’ the District Governing Board voted unanimously to place Bryan Reece on ‘paid administrative leave,’ and they named Executive Vice Chancellor of Education and Technology Mojdeh Mehdizadeh acting chancellor.”

“Spending hundreds of thousands of dollars on managers who don’t report to work certainly seems like a waste, but as we have noted in the past, these decisions are hard to evaluate since most of the facts are kept private,” Michels added

He was also referring to two other senior administrators that are on paid administrative leave, placed there by Reece last year, Executive Vice Chancellor of Administration Eugene Huff and Vice Chancellor of Human Resources Dio Shipp. (See related article)

“The Governing Board and Dr. Reece have mutually decided to part ways,” said Governing Board President Dr. Judy E. Walters. “We thank Dr. Reece for his service to the District and wish him well as he relocates to Southern California to spend more time with his family.”

The Governing Board also approved a contract with Executive Vice Chancellor, Education and Technology, Mojdeh Mehdizadeh, to become the Interim Chancellor for the period of February 16, 2022, through June 30, 2024, at a starting annual base salary of $357,714. With more than 30 years of experience at the District, mostly in executive leadership roles, the Governing Board is confident Mojdeh provides the steady and stable leadership needed to help advance the District’s mission and vision.”

College District fighting release of investigation report on complaints made by current, former staff leaders

The issue dates back four years and more; board to hold special closed door meeting Wednesday to discuss lawsuits by the three staff members; judge to rule by Friday on release of report

The Contra Costa Community College District is fighting in court to prevent the release of an investigations report of complaints made by three employees in leadership of the District. Current members, Executive Vice Chancellor of Administrative Services Eugene Huff, Chief Human Resources Officer Diogenes “Dio” Shipp and former Chief Financial Officer Jonah Nicholas made California Public Records Act (CPRA) requests for the release of “Any and all investigation reports delivered to the District concerning complaints made by” them.

Huff and Shipp are currently on paid administrative leave and Nicholas now works for the Chabot Las Positas Community College District in Alameda County.

A “Notice of Intention to Produce Records and Court Documents” was sent Monday to former Governing Board Trustee Greg Enholm from Executive Vice Chancellor for Education and Technology Mojdeh Mehdizadeh. In it she wrote, “the District vigorously opposed the release of the requested records, namely the Investigation Report (‘Report’) prepared by Jessica Armijo, citing a variety of legal privileges including” the “right to privacy” of those mentioned in the Report. However, the letter continues, “In his Jan. 28, 2022 ruling…Judge Jerry Baskin found that none of the purported exemptions apply to the Report.”

The judge further “ordered the Report be submitted for an in-camera review for February 1, 2022” (today), the notice reads.

Mehdizadeh also informed Enholm that the release of the Report “would result in a public disclosure of records containing information related to your role as a Governing Board member”. She suggested if he also objected to the release of the information that he could use a “reverse-CPRA action” for judicial relief and obtain a court order preventing the disclosure.

However, Enholm said he doesn’t care if any information about him or the Report is released.

According to the notice, the District is required to provide a copy of the Report of the investigations by Wednesday, Feb. 2 and “the Court intends to issue its final ruling”, this Friday, February 4 11:15 am.

A special closed session board meeting has been scheduled for Wednesday afternoon at 2:00 p.m. during which the trustees will discuss litigation with their legal counsel. The cases are Huff et al. v. In addition, the board will again discuss the “Public employee discipline/dismissal/release/complaint (Government Code Section 54957)” of Chancellor Bryan Reece.

Huff Explains

“Because we are in litigation, I’m probably not going to answer all your questions,” Huff said when reached for comment. “But I’m happy to provide you with the facts.”

“We have the same attorney and we filed two lawsuits against the District,” he continued. “One is the writ Judge Baskin heard, last Friday, which resulted in our favor.” Regarding the other lawsuit, “we filed a claim against the district about employment discrimination and retaliation.”

The lawsuit filed in court is a public document, Huff pointed out.

“Dio, additionally, has stand-alone claims,” he added.

“We were contract administrators at the time,” Huff stated. Their contracts were not renewed. “We filed for documents related to complaints filed in 2020.”

Dio was put on paid administrative leave in June. Huff was placed on administrative leave in August.

Asked if there was a date certain to the end of his paid leave, Huff replied, “It’s unusual to have a person on paid administrative leave indefinitely. But my current contract runs through June 2022. So, maybe they’re going to just wait it out.”

Biden-Harris Administration, House Democrats working to attract more foreign students, workers for American technology jobs

American tech workers not happy, say policy change “destroys the career prospects of young American graduates”

President Biden and Vice President Harris issued a statement on Friday, Jan. 21, 2022, announcing actions and policy changes their administration is taking to make it easier to attract foreign scholars, students, researchers, and experts to ultimately fill American technology jobs. In addition, on Tuesday, Biden issued a statement announcing his support for the America COMPETES Act of 2022 (H.R. 3593).

In addition, according to an announcement issued today by the Departments of Homeland Security and Labor, tomorrow, Friday, Jan. 28, the Biden administration will make 20,000 additional temporary nonfarm, H2-B work visas available for hiring through March, delivering on a demand from business groups.

“The supplemental H-2B visa allocation consists of 13,500 visas available to returning workers who received an H-2B visa, or were otherwise granted H-2B status, during one of the last three fiscal years. The remaining 6,500 visas, which are exempt from the returning worker requirement, are reserved for nationals of Haiti, El Salvador, Guatemala, and Honduras,” the joint statement reads. “The H-2B program permits employers to temporarily hire noncitizens to perform nonagricultural labor or services in the United States.”

Also, according to a Bloomberg Law article, published yesterday, Democrats have included a new entrepreneur visa in a House bill.

“Nonimmigrant visas for owners and key employees of start-ups as well as their family members and other STEM-boosting measures are part of legislation introduced by Democratic House leaders this week. The Senate last year passed its own version of the legislation, which President Joe Biden’s administration has identified as a key priority,” the article reads. “The bill, which also exempts immigrants with doctorates in science, technology, engineering, or mathematics fields from annual green card caps, is part of a broader legislative package released Tuesday that seeks to strengthen U.S. competitiveness with China in research and development.”

American Tech Workers Not Happy

But an organization of American technology workers, U.S. Tech Workers, which describes itself as a “nonprofit representing the voices of American workers harmed by the H-1B visa program and pushing Congress for reforms to protect workers”, are not happy with the Administration’s policies nor the Democrats’ legislation.

In a post on the group’s Twitter feed on Monday, Jan. 24, they wrote, “employers lobbied the US government for the ability to hire foreign workers via guest worker visa programs so they could rig the free-market in their favor.”

The group is also opposed to the changes in the H-2B visa and OPT programs. They said the changes will encourage companies to discriminate against American job applicants.

“This is exactly the kind of policy that destroys the career prospects of young American graduates,” the group posted on their Twitter feed. “USCIS (U.S. Citizenship and Immigration Services) is incentivizing employers to discriminate against US grads because the OPT program provides employers who hire foreign students: – FICA tax exemptions – No wage standards.”

An article on the group’s website written by Joe Guzzardi, a nationally syndicated newspaper columnist who writes about immigration issues, and joined Progressives for Immigration Reform in 2018, reads, “STEM OPT’s expansion…is significant since the thousands of new foreign-born workers entering the labor pool will adversely affect employed U.S. tech workers or recent U.S. STEM graduates whose prospective careers could be jeopardized.”

In addition, the U.S. Tech Workers tweeted, “Exempting a certain category of foreign workers counting towards numerical Green Card caps is a deceptive & crafty tactic of INCREASING overall immigration numbers. It basically means there’s an unlimited supply of GCs for PhDs & their family (spouse/kids).”

In another tweet about Biden’s statement on the America COMPETES ACT of 2022, the U.S. Tech Workers wrote, “House version of America COMPETES Act of 2022 sneakingly adds immigration provisions: – Exempts PhD foreign students & their family from counting towards Green Card cap – Creates new visas for entrepreneurs.”

According to a 2021 Bloomberg article, “Businesses that hire foreign students are exempt from paying Medicare and Social Security taxes, amounting to a discount of 7.65%.”

Today’s agency announcements include:

  • The U.S. Department of State’s Bureau of Educational and Cultural Affairs (ECA) is announcing an “Early Career STEM Research Initiative,” to facilitate non-immigrant BridgeUSA exchange visitors coming to the United States to engage in STEM research through research, training or educational exchange visitor programs with host organizations, including businesses. ECA is also announcing new guidance that will facilitate additional academic training for undergraduate and graduate students in STEM fields on the J-1 visa for periods of up to 36 months.
  • Department of Homeland Security Secretary Mayorkas is announcing that 22 new fields of study are now included in the STEM Optional Practical Training (OPT) program through the Student and Exchange Visitor Program (SEVP). The program permits F-1 students earning Bachelors, Masters, and Doctorates in certain STEM fields to remain in the United States for up to 36 months to complete Optional Practical Training after earning their degrees. Information on the new fields of study will be communicated to schools and students in a forthcoming Federal Register notice. The added fields of study are primarily new multidisciplinary or emerging fields, and are critical in attracting talent to support U.S. economic growth and technological competitiveness.
  • DHS is issuing an update to its policy manual related to “extraordinary ability” (O-1A) nonimmigrant status regarding what evidence may satisfy the O-1A evidentiary criteria.
  • O-1A nonimmigrant status is available to persons of extraordinary ability in the fields of science, business, education, or athletics. In this update, DHS is clarifying how it determines eligibility for immigrants of extraordinary abilities, such as PHD holders, in the science, technology, engineering, or math (STEM) fields.
  • The new update provides examples of evidence that may satisfy the O-1A evidentiary criteria and discusses considerations that are relevant to evaluating such evidence, with a focus on the highly technical nature of STEM fields and the complexity of the evidence often submitted.
  • The update also emphasizes that, if a petitioner demonstrates that a particular criterion does not readily apply to their occupation, they may submit evidence that is of comparable significance to that criterion to establish sustained acclaim and recognition. Additionally, it provides examples of possible comparable evidence that may be submitted in support of petitions for beneficiaries working in STEM fields.
  • With respect to immigration, DHS is issuing an update to its policy manual on how U.S. Citizenship and Immigration Services (USCIS), a DHS component, adjudicates national interest waivers for certain immigrants with exceptional abilities in their field of work.
    • The Immigration and Nationality Act (INA) provides that an employer can file an immigrant petition for a person of exceptional ability or a member of the professions with an advanced degree. The INA provides that USCIS may waive a job offer requirement, allowing immigrants whose work is in the national interest to petition for themselves, without an employer.
    • The USCIS policy update clarifies how the national interest waiver can be used for persons with advanced degrees in STEM fields and entrepreneurs, as well as the significance of letters from governmental and quasi-governmental entities. This update will promote efficient and effective benefit processing as USCIS reviews requests for national interest waivers. This effort is consistent with the Biden-Harris Administration’s priorities to restore faith in the legal immigration system.

Contra Costa College Board votes for gerrymandered redistricting map protecting incumbents, splitting more cities

The Contra Costa Community College board, on a 4-0-1 vote, approved a final redistricting, staff-drawn map that keeps the ward boundaries significantly gerrymandered, protecting each of the incumbents for re-election. Ward 5 Trustee Fernando Sandoval voted to abstain. During a public hearing on Ward Equalization Based on the 2020 Census at their regular meeting Wednesday night, the trustees reviewed three maps drawn by district staff, and only one member of the public, a former trustee, spoke. The new wards will go into effect for this year’s November elections, in which both Ward 3 Trustee Rebecca Barrett and Ward 4 Trustee Andy Li face re-election if they decide to run.

In addition, the board again discussed the “Public employee discipline/dismissal/release/complaint” of Chancellor Bryan Reece during a special meeting at 5:00 p.m. But no reportable action was taken during the closed session.

During the staff presentation on redistricting, Executive Vice Chancellor for Education and Technology Mojdeh Mehdizadeh said, “This is the fourth meeting we’ve held in order to achieve equalization” which was the main focus of the staff-drawn maps. Those include a Community Roundtable on Ward Redistricting on Jan. 6.

“You wanted to see more maps and interactive maps, you wanted to have the high school markers placed on the maps and more time for public input,” she continued. “We also asked the public for more input through an online survey…which went live on Dec. 17. We received a total of 12 responses.”

Three maps were offered to the public, two that are very similar to the current wards map, and one similar to the map that the county Board of Supervisors adopted, with a significantly gerrymandered Ward 2 which is very different than Supervisorial District 5. (See related article)

“Nearly 60% (7 people) indicated that Map 2 is the favored map. Map 3 was the least favored map. About 75% of respondents (8 or 9 people) said it was the least favorite,” Mehdizadeh stated. “We continue to offer Map 2 as the best map.”

That was the same map she and the district’s attorney recommended previously.

The three proposed maps show the locations of the high schools in the county except for Deer Valley High School in Antioch and misspelled the name of Dozier-Libbey Medical High School, also in Antioch.

Splits More Cities

While the new trustee ward map has a total population deviation of just 1.7% between wards – which is closer to the intent of the Constitution of ensuring one-person-one-vote – it keeps things pretty much the same as the 2011 map. It continues to split Antioch, Brentwood and Pittsburg in East County, Martinez, Concord, Walnut Creek and now, one of the county’s smallest cities, Clayton, in Central County, and in West County, instead of splitting Pinole, as the current map does, the new map splits Hercules.

Public Comments

Former board trustee Greg Enholm was the only person to speak during public comments saying, “as a trustee for 2012 to 2020 I did not participate in the ward equalization process for the 2000 and 2010 Census data. But I was affected as a candidate for the subsequent 2006 and 2010 Ward 3 elections created from the 2000 Census Data and the 2012, 2016, and 2020 elections created from the 2010 Census Data.”

“I have been a candidate in five contested elections being elected in two,” he continued. “I have had many opportunities to interact as a candidate with the approximately 200,000 4CD constituents each in Wards 3 and 5 as well as eight years being accountable to all one million 4CD constituents. I believe that the voters must select their representatives not the reverse. I hope that all five trustees agree with that statement and will ask that staff prevent or at least reveal any inappropriate effort by any current or prior trustee to use ward equalization to primarily improve their opportunity to be re-elected or affect any current or prior trustee’s opportunities to be a successful candidate using the 2000, 2010, and/or 2020 ward equalization process.”

Enholm provided each of the trustees with a copy of his comments on the three maps proposed by staff.

“Please read my comment below on all three proposed maps and ask staff if they have assured that the 2000 and 2010 ward maps were created in full compliance with all applicable laws, rules, and regulations in effect when they were adopted,” he said.

Trustee Comments

Ward 3 Trustee Fernando Sandoval was the only member of the board to speak, asking, “Can you tell me the implications for adopting each map? Can we respond to Mr. Enholm’s question…if the maps were created fairly.”

All three maps comply with population balance, Mehdizadeh pointed out.

“Map number 1 is a slight variation of the first one we presented you,” she said. “As it pertains to the second map, we attempted to keep as many cities as tight knit.”

However, both proposed Maps 1 and 2 split more cities than the current ward map.

“The third map was a request that came from the December meeting…that the Board of Supervisors had adopted their map…that was a consideration, as well,” Mehdizadeh stated.

In response to Sandoval she said, “Your question about the 2000 and 2010 process, I personally was not involved in the 2000 process.”

Mehdizadeh again spoke of population balance.

“In 2010 I can tell you I was directly involved,” she stated. “We worked closely with our legal counsel…we spent quality time with our governing board to get public input.”

“Our county Office of Education chose to adopt the same map,” Mehdizadeh added. “That showed a reduction in costs” for printing and mailing ballots during elections.

“I do know they have a meeting on the 19th,” Sandoval said referring to the county Board of Education. “But this year they hired their own demographer. I don’t know why. Is there a reason we wouldn’t wait for them to come back? We want to make sure the alignment is consistent. Would it be prudent to wait until they vote on a final recommendation?”

“That could be our challenge,” Mehdizadeh responded. “Our maps have to be approved by the end of February. It really is who ultimately who votes and makes a determination of their maps. They have been working closely with us, as staff. They are very well apprised of the timelines. It really is up to the board.”

With no other comments by the trustees Board President and District 2 Trustee Judy Walters closed the public hearing.

Board Adopts Map 2

Then later during the meeting, under NonConsent Agenda – Action Items – Miscellaneous, on a motion by Trustee Li and seconded by Ward 1 Trustee John Marquez, the board voted 4-0-1 to adopt Map 2. Sandoval voted to abstain. Student Trustee Austin Green also voted for the motion, but the vote is advisory, only.

However, the resolution signed by both Walters and Marquez, who is the Board Secretary, incorrectly shows Sandoval voted for the map and Marquez voted to abstain. 4CD adopted Ward Equalization Resolution 0122-20B-MI – incorrect

When reached for comment about the mistake Sandoval said “that’s wrong. I’ll call John Marquez.”

When informed of the mistake, Marquez said, “I’ll call the staff member who handles that, Pat (Kaya) and get it corrected, right away.”

In response to public pressure, the Contra Costa Community College District (4CD) Governing Board is seeking additional community input to adjust trustee ward boundaries and ensure population balance based on county demographic changes identified in the 2020 Census. During the Dec. 8 board meeting, (see 36-minute mark) Ward 5 Trustee Fernando Sandoval and Ward 2 Trustee Rebecca Barrett pressed for more public input, and wanted to review more than just the one map provided by the district’s staff and attorney David Saldani. They only provided slight changes to the current, gerrymandered map. (See related article)

Board Calls for More Public Input

At their December 8, 2021, meeting, (see item 10.A.) the Board reviewed only one staff-recommended map that highlighted how trustee area boundaries could change and received community input on the proposed map before determining the need for additional community input. In 2010, both the college board and the Contra Costa County Board of Education adopted the same exact maps, according to Saldani. The 4CD staff is expected to collaborate with the board of education, again, this year.

Only two members of the public offered comments during the hearing, including former college board trustee Greg Enholm who said “I hope the trustees agree that voters should choose their representatives not the reverse.  He also said he agreed with this reporter “regarding his concerns about the proposed ward map,” referring to the current map being drawn based on political considerations to protect incumbents at the time it was adopted.

“I also hope that Board Vice President Walters and Board Secretary Sandoval will explain why they are not advocating for an independent redistricting body to redraw the wards as they pledged to do,” Enholm stated.

“The map must be the best one possible meeting all requirements,” he concluded and said he provided to the trustees a copy of the 1990 ward map.

“We support a good governance model which includes community meetings. We are a little surprised that…the college district did not engage in a community participation process,” said Maria Alegria, representing Latinx for Inclusion. “It looks like you’ve done this in-house for the past three decades.”

Barrett had questions about the process, including the FAIR Maps Act.

“Certainly, this year, more than ever, the politics surrounding redistricting is greater,” said Executive Vice Chancellor, Education and Technology Mojdeh Mehdizadeh. “This is the first year that the Census data was released six months later than usual.”

“Can you explain the California FAIR Maps Act of 2017 and how it impacts the way cities and counties conduct their post-Census redistricting?” Barrett asked.

“We don’t have to comply with the provisions. It gives more direction with the criteria,” Saldani responded. “The FAIR Maps Act requires cities and counties have…two pre-map hearings then two post-map hearings. It doesn’t apply to the college district.”

“We used traditional redistricting criteria,” he added.

Sandoval said “you spoke about population balance. You guys really didn’t talk about communities of interest. What Mr. Enholm stated…there was some work that was done for political boundary changes in the past and I’m concerned those still haven’t been addressed.”

“It’s not just population balance, it’s communities,” Sandoval continued. “We’re here to make sure the maps represent the communities of interest as they go forward.”

“The other thing I’m concerned about is, the map itself that we have in there, is not an interactive map. You should be able to show that,” he stated. “The fact that we only have one map says that we only have one option. I’m all about transparency. When I talked about the independent commission it’s really about transparency and making sure that the public has an opportunity to weigh in and put a comment…so the board can go ahead and try to understand what the concerns of the community are. We don’t know what they are, right now. I think we need to do more.”

“From my perspective there’s not have enough transparency and we need to ensure we go ahead and take care of the public interest,” he concluded.

“In fact, we heard public feedback, tonight,” said Saldani.

“I think we haven’t done enough,” Sandoval responded. “Give them more of an opportunity. Publicizing it and just having it on our website is not enough. We should have more than one map.”

Barrett then said, “I do have some concerns. I would like to have a more detailed map. Are the politicians giving feedback? Because it’s self-serving. The staff and demographer have worked to keep this away from board input. In some respects, I would hope the board and public could get a more detailed map with geographic markers…things to help identify. I would appreciate a little more detail and understanding. I think the board could give you more input that communities of interest don’t fit nicely…in your statistical analysis. I do think multiple maps would have been helpful. It would give the public a sense that there are choices.”

“I think most of us won’t be here, in 10 years on this board,” she continued. “So, one of the things we can do as a board is to codify our expectations around the redistricting process. Do we want to look at an independent redistricting commission or some kind of hybrid? But that’s a more long-term project.”

“Your free of the accusation that you’re trying to benefit yourself,” Barrett added.

“Would it be possible to have, I’ll use the word workshop, or gathering?” asked Board Vice President Judy Walters.

“Certainly. I thought that’s what we were doing, here, tonight,” responded Mehdizadeh.

Walters suggested a meeting that is “less formal…more of a roundtable kind of thing.”

“On a personal level, I’m happy with the work done, tonight,” she said. “I’m concerned that we have to meet our deadline and we don’t spend a jillion dollars doing stuff.”

“We’re happy to answer any additional questions and do a deeper dive from an interactive perspective,” Mehdizadeh responded. “While we would love to do that, we’re not resourced to do that.”

“We tried to keep it in-house. Let them do their independent work,” Board President Andy Li said. “I’m supportive of some open, community input.”

“The document…that’s…showing racial demographics is wonderful,” Walters added. But she didn’t call for an independent citizen redistricting commission as she committed to do during her campaign, last year.

“I heard some requests to follow the county in drawing our districts,” Li said. “But I found that there are three trustees in the same ward.”

However, where incumbents live is not a requirement that must be considered when redrawing ward boundaries.

“I appreciate the work done by the county. But they have different communities of interest than we do,” Barrett said. “We could be drawing our maps off of the school district boundaries.”

“We tried to keep as many as communities together as possible,” Mehdizadeh said.

Staff agreed to consider offering more public meetings and has since offered two more maps and post all three on the district’s website.

January 6 Community Roundtable on Ward Redistricting

The public can review three mapping options of how trustee boundaries could be balanced on the 4CD website located at www.4cd.edu/gb/redistricting. Community members can use a new interactive mapping feature that will help identify how each mapping option could change your trustee representation. The website also gives the public the opportunity to provide online comments and feedback that will be considered by the Board. In addition, 4CD will conduct a Community Roundtable on Ward Redistricting during a special Governing Board meeting via Zoom on Thursday, January 6, 2022, beginning at 5:00 p.m. to conduct a community roundtable to review the different mapping options and receive additional community input. Zoom details can be found in the official Governing Board meeting agenda for this community roundtable.

January 12 Second Redistricting Public Hearing

The Board will review the additional community input and hold a second redistricting public hearing at their regularly scheduled public meeting on January 12, 2022, beginning at 6:00 p.m. The public is invited to attend this meeting in-person at 500 Court Street, 2nd Floor Board Room, in Martinez or via Zoom. Zoom details for this meeting are contained in the official Board meeting agenda located on the 4CD website.

“Based on the community input we received so far, the Board decided it was prudent to expand the redistricting choices available and provide more opportunity for the public to weigh in on this important decision,” said Walters. “The additional steps we are taking, which are beyond what is legally required, are appropriate and convey to our community we are rebalancing our trustee wards in a transparent way, and is being completed in a fair, objective, and non-partisan manner.”

Special districts like 4CD are legally obligated to follow Education Code Section 5019.5, which highlights the process to follow, ensuring the population of trustee wards is balanced based on the changing demographics of the community. Legally, the population can be as great as 10% between districts. Despite receiving the 2020 Census data six months late, 4CD is still required to complete this process by February 28, 2022.

After receiving the 2020 Census data in September 2021, staff began working with legal counsel to analyze and prepare its ward redistricting recommendation. The Board received a report outlining the plan to rebalance the ward boundaries at their November 10, 2021, meeting, including a review of the population changes throughout Contra Costa County.

Public Participation

Should you wish to make public comment in person, please fill out the yellow public comment card (sample attached) that will be available at the meeting and give it to the Executive Coordinator.  For those attending remotely, the Governing Board President will ask for general comments or those specific to a certain agenda item.

According to Government Code Section 54954.2(a), when responding to public comment, Governing Board members and staff may respond as summarized below.

  • Briefly respond to statements made or questions posed by persons making public comment;
  • ask questions for clarification or make a brief announcement;
  • provide a reference to staff or other resources for factual information;
  • request staff to report back to the body at a later meeting; or
  • direct staff to place the matter on a future agenda.

DVC and LMC recognized for Black and Latino Associate Degree for Transfer Rates

Recipients of 2021 Equity Champion of Higher Education Award

Diablo Valley College (DVC) and Los Medanos College (LMC) each received the 2021 Equity Champion of Higher Education Award, an honor given by the Campaign for College Opportunity (Campaign) to recognize California Community Colleges and California State University (CSU) campuses for their success in conferring the Associate Degree for Transfer (ADT) to Black and Latino students at higher rates than other colleges.

ADTs were established in 2010 with the passage of SB 1440, to create a clearer pathway for students who wish to transfer and earn a bachelor’s degree. Since the program’s inception, California Community Colleges have awarded more than 300,000 ADTs, establishing this pathway as a popular transfer option for students. By successfully completing 60 units of transferrable community college coursework, students will be awarded an associate degree and receive guaranteed admission with junior standing at a CSU campus.

“We are honored to receive the recognition that DVC led all California Community Colleges in increasing the number of Black and Latinx students earning an ADT,” says DVC President Susan Lamb. “We appreciate the ongoing recognition from the campaign, and want to thank every member of our college community for their contribution to this tremendous achievement and equity work.”

According to Campaign rankings, during the 2019-20 academic year, DVC awarded 1,161 ADTs, more than half of all Associate Degrees awarded by the college during this time. Black and Latino students out earned ADTs over other student populations at the college by 6% and 3.4% respectively.

LMC was recognized for their equity work in increasing the number of Latinx students obtaining an ADT. During the 2019-20 academic year, LMC awarded 548 ADTs, or one of every three Associates Degree awarded by the college during this time. LMC’s Latino students out earned ADTs over their other student populations by 2.9%.

“I am honored to work with such dedicated classified professionals, faculty and managers, who are focused on learning, completion, and equitable outcome for all of our students,” says LMC President Bob Kratochvil. “With a Latinx student population of over 40 percent, this recognition gives us another indicator we are on the right path and making progress in helping our students achieve their educational goals with us.”
