Contra Costa DA: price gouging is illegal during state of emergency

The Contra Costa County District Attorney’s Office wants to remind all residents that price gouging is illegal while our community is under a State of Emergency from the emergence of the novel coronavirus/COVID-19.

Price gouging is when a retailer or seller is attempting to take unfair advantage of the public during an emergency by increasing prices in an unreasonable manner for essential consumer goods and services. California’s anti-price gouging statute, Penal Code Section 396, prohibits raising the price of many consumer goods and services by more than 10 percent after an emergency has been declared.

Members of the public are encouraged to report any instances of gouging to our Consumer Protection Unit by email at DA-ReportFraud@contracostada.org. Individuals may also fill out a consumer complaint form on our website. Violators of the price gouging statute are subject to criminal prosecution that can result in a one-year imprisonment in county jail and/or a fine of up to $10,000. The DA’s Office is charged with enforcing this statute. Additional civil enforcement action may also be taken by our Office to protect consumers. The California Attorney General’s Office also issued information on price gouging during this emergency.

DA seeks help identifying person in human trafficking investigation

Newark man pleads guilty for two counts of attempted kidnapping for rape of Walnut Creek, other women

Yesterday, Wed., March 11, 2020 defendant Matthew Caruso of Newark (38-years-old) pleaded guilty to two felonies of attempted kidnapping for rape, one count for each victim in the case. Judge Laurel Brady of the Contra Costa County Superior Court accepted the guilty plea and sentenced Caruso to nine years in state prison.

Last year, Caruso was charged with four felonies by our Office after an extensive investigation by the Walnut Creek Police Department. Caruso tried to abduct Jane Doe outside of her apartment in the early morning of March 26, 2019. Fortunately, the attack and kidnapping failed, but Caruso tried to use a taser to subdue the victim. He then fled the scene wearing an elaborate disguise.

Not only was the primary victim able to fend off her attacker, but a witness noticed that the suspect dropped his phone in nearby bushes as the victim thwarted the attack. A few hours before this attack, Caruso drove by another victim’s residence but did not engage with this victim.

A particularly observant civilian in Fremont helped to catch this defendant with his quick thinking. The good Samaritan found disturbing notes from Mr. Caruso explaining his desire to kidnap and rape multiple victims, zip ties, and a mask in a dumpster and immediately called the Fremont police. The officers in Fremont did an amazing job of sifting through the garbage in that dumpster to locate a receipt that they traced back to the defendant.

Teamwork between attentive community members and diligent police officers brought this suspect to justice and made the community safer.

To protect their confidentiality, our Office does not release the name or age of the victim, or their relationship to a defendant for this type of case. A criminal protective order was also ordered by the judge to prevent the defendant from communicating with either victim.

The case was investigated by the Walnut Creek Police Department. Deputy District Attorney Bryan Tierney prosecuted the case on behalf of the People. DDA Tierney is assigned to our Sexual Assault Unit.

Richmond High P.E. teacher sentenced to 3 years in state prison for sex with minor

Earlier this week, Israel Ayala-Lopez (27-years-old) of Richmond pleaded guilty to unlawful sex with a minor, Jane Doe, and he will serve three years in state prison. Ayala-Lopez will also have to register as a sex offender for the rest of his life. Ayala-Lopez at the time of his arrest in the late summer of 2019, was a physical education teacher and soccer coach at Richmond High School. He received his teaching credential from the state of California in 2017.

Ayala-Lopez had sexual relations with the victim multiple times from at least April 2019 until August 2019. He was arrested by the Richmond Police Department and has been in custody since our Office filed criminal charges against him. Ayala-Lopez was also a collegiate athlete at San Jose State University and California State University Monterey Bay for their respective soccer teams.

To protect their confidentiality, our Office does not release the name or age of the victim, or their relationship to a defendant for this type of case. A criminal protective order was also ordered by the judge to prevent the defendant from communicating with the victim.

The case was investigated by the Richmond Police Department. Deputy District Attorney Kate Jewett prosecuted the case on behalf of the People. DDA Jewett is assigned to our Sexual Assault Unit.

Concord man arrested for Tuesday stabbing, charged with attempted murder

On Tuesday, Feb. 18, 2020, just after 3:10 p.m., Concord Officers responded to a fight on Meadow Lane near Riley Court. When the first officer arrived on scene, he discovered the victim lying on street with multiple stab wounds. The suspect fled the area but, was located by one of our observant officers half-a-mile away. Several witnesses positively identified the suspect, 25-year-old Concord resident Jose Mario Calonge Aguilar, as being responsible for repeatedly stabbing the victim. At this time, it appears the attack was unprovoked.

The victim was transported to the hospital and is currently in stable condition in the Intensive Care Unit.

The Concord Major Crimes Unit actively investigated this case. Some of this brutal attack was captured on surveillance and shows numerous vehicles stopped in traffic while the victim was being assaulted.

Friday, Feb. 21, 2020 CASE UPDATE: The suspect, Jose Mario Aguilar, was located by one of our officers and positively identified by several witnesses. Much of this brutal attack was captured on home video surveillance systems located in the neighborhood, which assisted Concord Major Crimes Unit Detectives with their investigation.

We wanted to let you know that yesterday the Contra Costa County District Attorney’s Office filed charges against Aguilar for attempted murder (P.C. 664/187), and assault with a deadly weapon (P.C. 245(a)1) with enhancements. Aguilar will be held in custody on a $1.19 million bail. As we previously posted, the victim in this case is in stable condition. Thank you to the community members who called 9-1-1 and who assisted us with our investigation.

Four suspects charged for auto repair insurance fraud from undercover operation in Contra Costa

The Contra Costa County District Attorney’s Office and the California Department of Insurance partnered to conduct an undercover operation targeting auto repair insurance fraud in Contra Costa County. Today investigators arrested the last two of four employees at four different auto repair shops caught in the sting operation.

Auto repair shops provide estimates to customers for insurance claims knowing that the customer’s ultimate decision on whether to proceed with the repair, and pay for it, may depend on the insurance company approving and paying out for the claim. This can create an incentive for the estimator to overlook or even encourage a customer known to be committing a fraud. Accepting business with knowledge or reckless disregard for the fact that a customer intends to commit insurance fraud is a felony punishable by up to three years in prison and an additional fine of up to $50,000.

An undercover officer visited several auto body repair shops in Contra Costa County and told estimators that they wanted to claim and repair pre-existing damage on a new insurance policy initiated after the damage occurred. The officer requested a repair estimate from the shop to assist with the false insurance claim.

Four individuals have been charged in the sting operation including:

Kyle Coburn (30-years-old) of AW Collision in Concord;

Marco Hernandez (49-years-old) of 101 Auto Body in Richmond;

Estephanie Gonzalez-Marquez (26-years-old) of Tepa Autobody in Pittsburg;

Vu Hoang (33-years-old) of Kee’s Auto Body in Concord.

The District Attorney’s Office also reminds consumers to be wary of listening to anyone who suggests lying to an insurance company related to an insurance claim. Providing false or misleading information in support of an insurance claim is a felony punishable by up to five years state prison and an additional fine of up to $50,000.

Walnut Creek man sentenced to prison for trying to meet minor online for sex acts

Martinez, Calif. – On Friday February 14, 2020, Justin Arthur Cook, a 34-year-old Walnut Creek resident, pleaded guilty to one count of arranging to meet a minor to engage in sex acts. Cook was immediately sentenced to four years in state prison by the Honorable David Goldstein and ordered to register as a sex offender for life.

On August 4, 2019, Cook used a social media site to inquire about family incest. An undercover police officer contacted Cook and they began to message each other. During the conversation, and over the next four days, Cook learned the undercover officer had a 7-year-old daughter and made repeated statements he wanted to sexually abuse the young girl. On August 8, 2019, Cook traveled to Target in Walnut Creek to purchase a bottle of “lube” and then to an apartment complex in Walnut Creek to meet the child. Cook was arrested and admitted to communicating with the undercover officer.

On August 12, 2019, Cook was charged by the Contra Costa County District Attorney’s Office and he has remained in custody since the date of his arrest. Cook will begin to serve his sentence immediately. Deputy District Attorney Kate Jewett prosecuted the case on behalf of the People.

The investigation was conducted by a multi-agency Internet Crimes Against Children Task Force, which is managed by the San Jose Police Department. In Contra Costa County, detectives and investigators from the Walnut Creek, Pleasant Hill, Martinez, San Ramon, Concord and Moraga Police Departments, the Contra Costa County Sheriff’s Office, United States Secret Service, Homeland Security Investigations, the Contra Costa County Probation Department, and Inspectors from the Contra Costa County District Attorney’s Office participate in the task force. The District Attorney’s Office would like to thank the Concord Police Department’s Violence Suppression Unit for the substantial assistance they provided with the investigation.

Concord teen who killed mother Wednesday night identified, charged with murder Thursday

According to papers filed in court Thursday by the Contra Costa District Attorney’s office, the 18-year-old Concord teen who called police telling them he had killed his mother on Wednesday, Feb. 5, 2020 has been identified as Harrison William Mercier. He is charged with the murder of Elizabeth A. Barry. (See related article)

The filing papers allege Mercier used a knife to kill Barry and that it was premeditated, with “malice aforethought”. Complaint Mercier February 6 2020

According to Concord Police press release, on February 5th, at approximately 9:00 PM, Mercier called Concord Police Dispatch saying he had just killed his mother at their home located in the 3000 block of Treat Blvd. When Officers arrived, the man was outside waiting for them. His mother was found deceased inside the home. Mercier was arrested and CPD Detectives are currently investigating the case.

Suspect in December Pittsburg murder arraigned in court Thursday

According to the Contra Costa District Attorney’s office, murder suspect, Mark Thomas was arraigned in Contra Costa County Superior Court yesterday, Thursday, Feb. 6, 2020 for allegedly killing Rafael Rodriguez Lopez with a shotgun during a robbery in Pittsburg on Dec. 14, 2019. According to a Pittsburg Police press release issued later that day, “Early Saturday morning, just after midnight, Pittsburg Officers responded to the report of a shooting at a residence in the 200 block of Havenwood Circle. Upon arrival, officers located a 30-year-old male resident suffering from a gunshot wound to the torso. Officers provided aid to the man until medical personnel arrived. The man later died from his injuries.

Pittsburg Police Department Detectives and Crime Scene Personnel responded to the residence to conduct the investigation. From initial information, officers learned that two masked gunmen entered the residence and engaged in an altercation with the man and other people inside the residence. During this, the two suspects shot the victim and fled the residence in a gray or silver import sedan. Investigators are working to confirm information the man and the suspects knew each other, and this incident was the result of a disagreement that had occurred.”

It was the city’s seventh murder in 2019.

Thomas is being held without bail.

Two men charged with burglary of over $65,000 in jewelry from Walnut Creek Macy’s

Earlier this week, the Contra Costa County District Attorney’s Office filed multiple felonies against Christopher Dopp, a transient with no known address, and Richard Lange, from Richmond, for last week’s burglary of the Walnut Creek Macy’s store at Broadway Plaza. During the early morning burglary of January 24, the defendants took $65,244 of gold jewelry from display cases.

The defendants were spotted by store employees on the first floor of the store as the pair smashed display cases. The defendants fled the scene after the employees saw the pair destroying the display cases. Ultimately, Walnut Creek Police Officers apprehended the burglars as they left the store. In total, the damage to the store totaled over $80,000 from the broken glass.

The bail for each defendant is set for Lange at $170,000 and Dopp at $35,000. The defendants are not in custody as they bailed out.

The specific felony charges are as follows:

Lange: Second Degree Burglary, Grand Theft of Personal Property, Vandalism Over $400 Damage — Special Allegation Serious or Violent Felony Prior & Special Allegation Two Prior Offenses

Dopp: Second Degree Burglary, Grand Theft of Personal Property, Vandalism Over $400 Damage
